TERMS OF USE & PRODUCT DISCLAIMER – Pristine X

1. Agreement

By accessing pristinex.co.za or purchasing our products, you agree to these Terms, governed by South-African law.

2. Orders & Payment

All prices include 15 % VAT.

Orders become binding only after payment is received.

Pristine X may refuse or cancel any order (with full refund).

3. Delivery & Risk

Orders ship via independent couriers. Delivery times are estimates; Pristine X is not liable for courier delays or loss once goods leave our premises.

Risk passes to you when the parcel is collected by the courier. Inspect parcels upon arrival and notify us of damage within 48 hours.

4. Product Safety & Usage

4.1 Products are formulated solely for the uses stated on the label.
4.2 Always follow the Safety Data Sheet (SDS), dilution ratios and personal-protective-equipment (PPE) instructions.
4.3 Keep chemicals out of reach of children and pets.
4.4 Indemnity: To the fullest extent permitted by law, Pristine X (Pty) Ltd, its directors, employees and agents shall not be liable for any injury, loss or damage arising from (a) misuse, (b) failure to follow instructions, or (c) unauthorised mixing with other substances. (This indemnity does not limit your statutory rights under the Consumer Protection Act 68 of 2008.)

5. Returns & Defects

Defective items may be returned within 7 days of delivery for replacement or refund. Opened or used chemical products are non-returnable unless defective.

6. Disclaimer of Warranties

Except as expressly stated, products and site content are provided “as is”. We disclaim all implied warranties of fitness for a particular purpose. Your sole remedy is replacement or refund under clause 5.

7. Limitation of Liability

Pristine X’s total liability for any claim is limited to the invoice value of the product giving rise to the claim. We are not liable for indirect, special or consequential damages.

8. Intellectual Property

All trademarks, content, formulas and designs are owned by Pristine X (Pty) Ltd. No licence is granted except for personal, non-commercial website viewing.

9. User-Generated Content

If you post reviews, photos or comments you grant us a non-exclusive, royalty-free licence to use them. Do not post unlawful, defamatory or infringing content.

10. Links to Third-Party Sites

External links are provided for convenience. We are not responsible for their content or availability.

11. Governing Law & Dispute Resolution

These Terms are governed by South-African law. Disputes will first be referred to AFSA mediation; if unresolved, either party may approach the Western Cape Division of the High Court.

12. Updates

We may revise these Terms at any time by posting an updated version. Continued use of the site after changes constitutes acceptance.
